Scott A. Faultless has proudly worked with personal injury clients for over 30 years. He has been recognized by the National Trial Attorneys Association as a Top 10 Trucking Trial Lawyer and a Top 100 Trial Lawyer and serves on the Executive Committee for the Indiana Trial Lawyers Association. Additionally, Scott is one of founding partners of Craig, Kelley & Faultless, which currently employs two of the only four attorneys in Indiana who are board-certified by the National Board of Trial Advocacy, accredited by the American Bar Association in truck accident law. The other board-certified attorney is his firm partner, David W. Craig. This year, Scott will be sharing his expertise with colleagues at the “Winning Truck Wreck Cases” seminar on August 4, 2025.
The seminar is co-chaired by Scott and David themselves, presented by the Indiana Trial Lawyers Association and will include several other speakers sharing their knowledge of the trucking industry and truck accident law.

Scott’s presentation will cover “Vicarious Liability for Independent Contractors” during the afternoon session of the seminar. Truck cases are complicated, and oftentimes there are multiple people at fault, not just the operator of the truck. To see the full value of a case, lawyers need to prove who all was liable for a wreck.
Vicarious liability typically refers to the liability that a supervisory party, or employer, takes on for the actions of a subordinate, or employee, while working for the supervisor. Attorneys typically need to prove that the employee was negligent, was acting within the course of their employment when the accident occurred, and that the employee’s conduct was a benefit to their employer.
However, independent contractors are not usually employed by one specific employer. Truck drivers that are independent contractors, or owner-operators, generally own their trucks and operate their own businesses. In this instance, the company that hired the driver may not be as liable for the accident as they would be if the driver was a full-time employee for that company.
Scott will discuss the importance of proving vicarious liability, how holding different people or companies accountable can influence the value of a case, and how independent contractors can affect liability.
Scott’s Professional Achievements
Scott has dedicated his career to representing the victims of large truck accidents, ranging from semi-trucks to buses, and has litigated cases throughout the Midwest in state and federal courts. He has also argued numerous cases before the Indiana Supreme Court, Indiana Court of Appeals, and the U.S. Court of Appeals for the 7th Circuit.
As a result of his extensive legal career, Scott has also been recognized by his peers as a Super Lawyers Honoree for over 10 years. He has shared his expertise with others by writing extensively and presenting topics to the Academy of Truck Accident Attorneys, the Association of Plaintiff Interstate Trucking Lawyers of America, the Indiana Trial Lawyers Association, and the Florida Justice Association. His efforts have culminated in him receiving the President’s Award from the Indiana Trial Lawyer’s Association in 2020 as recognition of his dedication to advocating for injured people and pursuing civil justice.
Dedication to His Community
While Scott spends plenty of his time working on cases, he also dedicates himself to his community through service and civic leadership. In 1995, he was elected to the Fishers, Indiana Town Council and served as the council’s president from 2001 to 2013. During this period, several publications considered Fishers among the best places to live in America.
Furthermore, Scott has received the Sagamore of the Wabash award, one of Indiana’s highest honors bestowed by the governor as recognition of civic service and leadership.
