Board Certification Recognizes Attorneys’ Excellence in Truck Accident Law

Only about 80 attorneys in the United States are certified in Truck Accident Law by the National Board of Trial Advocacy. Two of them are partners and founding members of Craig, Kelley & Faultless, a personal injury and wrongful death law firm headquartered in Indianapolis.

David W. Craig and Scott A. Faultless first earned board certification in Truck Accident Law in 2019. At that time, there were fewer than 50 lawyers in the country with this achievement.

What does board certification mean? What is NBTA?

The National Board of Trial Advocacy (NBTA) is an attorney board-certifying agency accredited by the American Bar Association. The organization’s mission is to help the public identify competent and honorable legal representation and to “promote excellence in legal advocacy.”

To earn board certification in Truck Accident Law, an attorney must complete a comprehensive vetting process. Qualifications for an eligible lawyer include:

  • Substantial trial experience
  • Extensive knowledge of truck accident law — proved through a written examination
  • Judicial and peer references attesting to their accomplishments in truck accident law
  • Attendance of continuing legal education courses in truck accident law — includes writing articles and books, participating in truck accident law organizations, speaking at truck accident law conferences, etc.
  • Proof of good standing and adherence to high ethical standards through enrollment in ethics courses and seminars, participation in ethics-based organizations, etc.

A lawyer seeking board certification must have considerable experience in trucking cases. They must prove that, in the three years preceding their application, they spent at least 30% of their time practicing truck accident law. They must have participated in at least five jury trial cases that went to verdict, among other criteria.

The importance of continued involvement in trucking cases

To retain one’s board certification, a lawyer must complete the recertification process every five years. They must prove that they spent the previous five years litigating truck accident cases and serving counsel or as co-counsel on truck accident cases. They will submit six peer references who can attest to the attorney’s proficiency in commercial motor vehicle cases.

The recertification process is crucial to board certification because it proves that each attorney is actively involved in a certain area of law.

The commercial trucking industry changes every day. It is important that lawyers re-establish their proficiency in truck accident law in order to keep their certification.

If, at the time of recertification, an attorney does not have recent, successful experience taking trucking cases to trial; if they have not attended or spoken at seminars and trucking conferences; or if they are not spending a considerable amount of their time on trucking cases, they are no longer qualified.
