Scott A. Faultless has served personal injury clients for over 30 years and is one of the co-founders and partners of Craig, Kelley & Faultless. He is one of the four attorneys in Indiana who are board-certified in Truck Accident Law by the National Board of Trial Advocacy, accredited by the American Bar Association. He has been named by the National Trial Attorneys Association as a Top 10 Trucking Trial Lawyer and a Top 100 Trial Lawyer and serves on the Executive Committee for the Indiana Trial Lawyers Association (ITLA). Additionally, Faultless has been recognized by his peers as a Super Lawyers Honoree for over 10 years. He has shared his expertise with others through writing and presenting topics to the Academy of Truck Accident Attorneys, the Association of Plaintiff Interstate Trucking Lawyers of America, the Indiana Trial Lawyers Association, and the Florida Justice Association.
Scott has dedicated his career to representing the victims of large truck accidents and has litigated cases throughout the Midwest in state and federal courts. He has also argued numerous cases before the Indiana Supreme Court, Indiana Court of Appeals, and the U.S. Court of Appeals for the 7th Circuit. His efforts have culminated in him receiving the President’s Award from the Indiana Trial Lawyers Association in 2020 as recognition of his dedication to advocating for injured people and pursuing civil justice.
The Montgomery Decision and Its Impact on Claims Against Brokers
Faultless’s session, title “Claims Against Freight Brokers After Montgomery”, will discuss how the recent United State Supreme Court decision, Montgomery v. Caribe Transport II, LLC, held that the Federal Aviation Administration Authorization Act of 1994 (FAAAA) cannot stop state-law negligent-hiring claims against freight brokers when those claims are related to motor vehicle safety. This allows injured plaintiffs to pursue negligence claims against brokers who have breached the duty of care when choosing their motor carriers.
When an injured person seeks to file a claim following a semi-truck accident, there are many people and companies that may be held liable for their involvement in getting that truck and/or driver on the road. Prior to this decision, freight brokers were often able to use the FAAAA to have personal injury and wrongful death lawsuits dismissed before a case went to trial. Now, this ruling allows those lawsuits to continue, affording attorneys and their clients the opportunity to put the decision of liability before a jury. Attendees will leave this session with a better understanding of how this decision will impact their truck wreck cases.
